Are Farmhouses in Noida Legal? The Honest Q&A, With Prakriti Farms as the Test Case

Are farmhouses in Noida legal? Yes, when title, location and approvals line up. Here is why well over a hundred farmhouses were demolished, what Section 80 does and does not do, and what we know about Prakriti Farms.

Are Farmhouses in Noida Legal? The Honest Q&A, With Prakriti Farms as the Test Case

"Are farmhouses in Noida legal?" It sounds like a yes or no question. It is not, and the people who treated it as one are the people who watched bulldozers on the Yamuna floodplain.

Here is the honest answer: a farmhouse in Noida or Greater Noida is legal when the land, its location and the construction all have the right approvals. Many have them. Some do not. Since May 2022, the Noida Authority has demolished well over a hundred farmhouses it declared illegal.

We sell farmhouse plots, including at Prakriti Luxury Farm Houses. That is exactly why we want you to understand the rules before you look at any of them, ours included. This Q&A uses only published reports and the details on our own project page.

Are farmhouses in Noida legal? The short answer

Yes, when three things line up:

  1. The land has a clean title and the seller is the recorded owner.
  2. The location allows it. It is not inside a notified floodplain, and not in land notified for acquisition.
  3. The use and construction are approved. Agricultural land may need a declaration for non-agricultural use, and any building needs its own sanction.

Miss any one of these, and the farmhouse can be legal on the sale deed but illegal on the ground.

Why were farmhouses demolished in Noida?

Mostly because of where they were built.

According to The Realty Today (updated 2 September 2025), the Noida Authority declared several farmhouses on the Yamuna floodplain illegal in May 2022, acting under the River Ganga (Rejuvenation, Protection and Management) Authorities Order, 2016. About 125 farmhouses were razed in the first phase starting May 2022, and 23 more were demolished in Sectors 150 and 151 on 26 August 2025.

The fight is not over. The same report says the Allahabad High Court ordered status quo on a petition by 30 farmhouse owners, who argue their properties are outside the high flood level zone. Until courts decide, buyers in disputed pockets are buying a legal question, not a farmhouse.

In May 2025, MillenniumPost reported that the Noida Authority planned drone surveys of the Hindon and Yamuna floodplains, FIRs against people selling farmhouses in the submerged area, and a requirement that new property deeds in flood-prone zones state that construction is not permitted there. The irrigation department also warned that the government would not compensate owners if floods damage unauthorised structures.

Did the authorities themselves ever run farmhouse schemes?

Yes, and the record is a warning in itself. A CAG audit reported by The Realty Today (updated 19 August 2025) looked at the Greater Noida Authority's Institutional Farm Houses scheme of 2011 and its Krishi Farm Houses scheme of 2015.

Under the Krishi scheme, permanent structures were built on plots, some about 130 metres from the Hindon river in a floodplain designated a natural conservation zone. The authority scrapped that scheme and refunded deposits with 4% interest. The audit also said the authority had ignored March 2010 government orders barring construction in floodplains.

The lesson: even an official-sounding scheme can go wrong if the land is in the wrong place.

What is Section 80, and do I need it for a farmhouse?

Under Section 80 of the Uttar Pradesh Revenue Code, 2006, agricultural land can be declared for non-agricultural use. The application goes through the tehsil machinery, and the SDM is the officer usually named for it, according to a 1acre.in explainer.

The same explainer makes a point many buyers miss: a Section 80 declaration does not by itself permit construction. Building sanction from the relevant authority or local body is a separate step.

So the right question to ask any seller is not "Is Section 80 done?" but "Is Section 80 done, and what approval covers the building I want to put on it?"

Does a farmhouse project need RERA registration?

Under Section 3 of the Real Estate (Regulation and Development) Act, 2016, a real estate project, including a plotted one, generally needs registration with the state RERA before it is advertised or sold, unless it falls under small-project exemptions such as land of 500 sq m or less. A 100-acre township is not small.

If a farmhouse township is selling before its RERA number is published, you are taking on more risk than a buyer in a registered project. That does not make it illegal to talk about, but it should change how much you pay and when.

What should I ask before booking a Prakriti farmhouse plot?

Ask us these, in writing, before you pay anything:

  1. What is the current RERA status, and when is registration expected?
  2. Which khasra numbers make up Phase 1, and can I see the title documents?
  3. Is any part of the land inside a notified floodplain or an acquisition notification?
  4. What land use status or Section 80 declarations exist for my plot?
  5. What will I be allowed to build, and which authority sanctions it?
  6. What is the registry and mutation process, and who bears the cost?

We would rather answer six hard questions than sell you a plot you regret.

Why did the Noida Authority demolish farmhouses?

It said they violated floodplain norms under the River Ganga Authorities Order, 2016. About 125 were razed from May 2022, and 23 more in Sectors 150 and 151 on 26 August 2025, according to The Realty Today.
